what is your setup like, for instance how deep is the water? Maybe it's not deep enough for him to swim underwater? Just a thought....

Are there objects in the tank, like fake plants, that he can rest on? Sliders are pretty active when they are not basking or sleeping.
Also avoid giving him too much protein. Maybe can rub some of the chicken flavor onto some pellets..

yea there are plants... when hes not basking hes not swimming.. he sleeps but its weird today i wake up and go put his light on.. and hes in the exact same position he was last night and so i pick him up and we go outside to see if he will be awake.. and he will barely open his eyes and wont bring his legs out.. i dont know if hes trying to sleep.. but hes been sleeping all night.. he doesnt go in the water at night.. he stays on his basking area but the light is off at night.. he confuses me

Is he eating and what are the water/basking temperatures? Lethargy is not normal behaviour.

I'd suggest NOT getting another one from the same store. That's how they are able to sell so many. They die, then people go back for more. Please don't support that. If you insist on getting another turtle, go through a reputable breeder.
btw, make sure you disinfect that tank if you're going to use it again.
