It's hard to tell what spots you are talking about. Can you provide a picture of the shell when it is dry?

My turtle has black spots on the edges and bottom of his shell that look a lot like those. They are just part of his normal pattern.

Look at the thread below. These little turtles have spots on their shell that look kind of like yours and they seem to be fine.

Samandnelly, when you first pull up this website, redearslider.com, there's a little turtle with spots on his shell. Do those look like your turtle's spots?

My RES has black "spots" on his shell as well (much like yours). They're part of the pattern on his carapace, and look really nice with all the yellow he has on him. :)
